  1. Your contract for purchases made through the System is with Dartmouth Festival Ltd, and you undertake that any and all service ordered by you are for your own private and domestic use only.   Your agreement as indicated on this website by either or tickbox, button, or other positive indication that you accept the Terms and Conditions of Purchase as listed herein will bind you to these Terms and Conditions for any purchases made on this System.
  2. By agreeing to these Terms and Conditions you represent that you are eighteen years old or older. If you do not qualify, please do not use the system.
  3. You agree that e-mail can be used as a means of communication.

5.1 No contract for the sale of any product will exist between you and Dartmouth Festival Ltd unless and Dartmouth Festival Ltd accepts your order by way of an e-mail confirming that it has received payment in full for all the service you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Dartmouth Festival Ltd sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by Dartmouth Festival Ltd of your offer to buy service from Dartmouth Festival Ltd or a third party supplier that is engaged on your behalf by Dartmouth Festival Ltd. This confirmatory e-mail will contain all relevant statutory information concerning your contract. The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with these terms and conditions from time to time.
5.2  You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
5.3  Payment may be made via our secure payment processors on the System or by phone.  We do not accept cheques.
5.4  Dartmouth Festival Ltd will not pass on your personal details to any third party, other than one of our payment service providers, without your authority. We shall be entitled to process your data in accordance with the terms of our Privacy Policy. Please view this document for further information. Our payment service providers are Paypal. Their privacy policy is available at either www.protx.com or www.paypal.com.
5.5 You undertake that all details you provide to Dartmouth Festival Ltd for the purpose of ordering or purchasing service or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the service or services ordered.
5.6 In order to make a purchase on the System (other than providing Credit Card details by telephone) you must register as a user of the System. You must choose a nickname and password as part of registration. Please see our general website terms and conditions regarding registration as a user as well as our Privacy Policy. You are responsible for all actions taken under that nickname and password and shall only use the System under your own nickname and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your nickname or password.
5.7  If there are any changes to the details supplied by you it is your responsibility to inform Dartmouth Festival Ltd as soon as possible.
5.8 International transactions: We cannot provide you with a 100% accurate figure at the time of purchase, because the exchange rates change every day and banks and credit card companies conversion rates each also vary . Bank and credit card companies may also add their own charge for currency conversion. We recommend that you ask your credit card company how much they charge for this service. Dartmouth Festival Ltd will charge your credit card in British Pounds Sterling and your credit card company will then convert that amount to your currency. There are many 'Currency Converter' tools on the web that can give you an idea of how much you will be charged.

5.9 Dartmouth Festival Ltd DO NOT store or retain any payment card or other financial information provided.

  1. Cancellations, Returns, Exchanges

6.1 Non-exchangeable and non-refundable:
Tickets for any activity.
Wokshops deposits & hotel payments.


6.2 Cancellations: You may cancel your order at any time prior to your order being processed. We can also accept cancellations by email to post@dartmouthfestival.com or by post or by telephoning 01803 832524 during normal UK office hours (10am - 6pm Monday to Friday). You may also withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order but no later than 7 working days after the day after you receive the product by sending the notice of cancellation by email to: post@dartmouthfestival.com  ensuring that you quote your name, address and order reference number.
Dartmouth Festival Ltd will refund you the purchase price of the service but not the cost of shipping and handling.
6.3 Once we receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited Dartmouth Festival Ltd from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of receipt of your returned order provided that the service you wish to return are received by Dartmouth Festival Ltd in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the service to Dartmouth Festival Ltd.

  1. Liability

7.1  This section applies only to the extent permitted by law. For the avoidance of doubt, Dartmouth Festival Ltd do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Dartmouth Festival Ltd negligence or wilful default, or that of Dartmouth Festival Ltd  employees, agents or subcontractors or (b) fraudulent misrepresentation.
7.2  Dartmouth Festival Ltd does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed service, products and services. Dartmouth Festival Ltd will do its best to correct errors and omissions as quickly as practicable after being notified of them.
7.3  If an error is discovered in the price of the service that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the System is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the service in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.
7.4 TO THE FULLEST EXTENT PERMITTED BY LAW, DARTMOUTH FESTIVAL LTD PROVIDES THIS SYSTEM AND ITS CONTENTS ON AN 'AS IS' BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SYSTEM OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SYSTEM INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, DARTMOUTH FESTIVAL LTD DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SYSTEM IS ACCURATE, COMPLETE OR CURRENT.
7.5 You and Dartmouth Festival Ltd will only be liable under these Terms for losses which are a reasonably foreseeable consequence of the relevant breach of contract.
7.6  The products sold on the System are provided for private domestic and consumer use only. Accordingly, Dartmouth Festival Ltd do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the System or for any products or services purchased from Dartmouth Festival Ltd.
7.7  We have no liability to you for any delay in the delivery of products ordered to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, civil commotion, malicious damage, explosion, governmental actions or any other similar events.

  1. Processing of orders

8.1 Credit cards and Debit cards are debited on the date of purchase. All prices include sales taxes (where applicable) unless otherwise stated.
8.2 Every purchase you make shall be deemed performed in England. English law shall govern every aspect of contractual agreement concerning purchases made from Dartmouth Festival Ltd.
8.4  It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
10.3. Dartmouth Festival Ltd may amend these Terms from time to time, and place the new version on the System. When Dartmouth Festival Ltd do so, it will mention the fact on our web site (www.dartmouthfestival.com). For users purchasing service or registering on the System for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms. Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the System. Your continued use of the System following Dartmouth Festival Ltd posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the System.
10.4  These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Dartmouth Festival Ltd and you relating to your purchase. Dartmouth Festival Ltd advises that you print off a copy of these terms and conditions prior to entering into any agreement to purchase service or services, and should keep a copy safe once your order has been accepted by Dartmouth Festival Ltd. We will store a copy of the contract entered into by you with Dartmouth Festival Ltd. You are advised to read (and are responsible for reading) fully all relevant information on this website.
10.5  If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.
10.6  These Terms and Conditions are subject to the laws and exclusive jurisdiction of England.
